Confidentiality

BavelasGroup will not provide personally identifiable information in the BavelasGroup database record to third parties except as noted under "Limits of Confidentiality." Personally identifiable information means the member's name, residence address, e-mail address, or other information from which the member's identity may be reasonably ascertained. BavelasGroup uses technologies to preserve the anonymity of members. BavelasGroup will under no circumstance knowingly reveal any Investors identity to marketers.

Limits of confidentiality

As part of its day-to-day business activities, BavelasGroup must disclose certain aggregate level information about the BavelasGroup database to certain third parties; principally, (1) BavelasGroup Users, and (2) Financial Advisors who contribute data to the BavelasGroup database. Below is the information and circumstances under which BavelasGroup may be required to disclose information to third parties.

1. BavelasGroup may disclose aggregate level information to users about the BavelasGroup database.
2. Financial Advisors: BavelasGroup will disclose aggregate level information about BavelasGroup files to Financial Advisors as reasonably necessary to explain the services that BavelasGroup can offer

Due to the existing legal, regulatory and security environment, BavelasGroup may be required, under certain circumstances, to disclose aggregate level and/or personally identifiable information about its members. BavelasGroup will use its best efforts to limit such disclosure to the following: where BavelasGroup believes in good faith that it is required to do so in response to a subpoena or other legal process; where reasonably required to do so in order to maintain, update or otherwise implement BavelasGroup data security measures, equipment, technical operations and the like; or where reasonably necessary to identify, contact or bring legal action against persons or entities to preserve and/or enforce the BavelasGroup rights.

Use of Information

BavelasGroup uses its database information to deliver the BavelasGroup service. Thus, both Investor and Financial Advisor information is used in aggregate in identifying information that may be of interest to its users. A person's e-mail address will be used by BavelasGroup to contact that Investor about selected interests, unless otherwise opted out of BavelasGroup e-mail communications.

Unsubscribe Policy

You can choose to unsubscribe from communications at any time. You can unsubscribe from communications by clicking here now: admin@bavelasgroup.com and typing unsubscribe in the subject line. Please allow up to 72 hours for the removal process to be complete.

Policy Changes

The foregoing policy is effective as of September 2008. BavelasGroup reserves the right to change this policy at any time. Please check this page periodically for changes. BavelasGroup will take reasonable measures to notify you if there is a material change in our privacy practices with respect to use of the information that has been provided to BavelasGroup. BavelasGroup will conspicuously post these changes in our Privacy Policy. BavelasGroup also will post a message on the home page of its Web site that states that the Privacy Policy has been changed, and will provide a link to the Privacy Policy. Miscellaneous

BavelasGroup also uses e-mail links located on various pages of the BavelasGroup Web site to allow you to contact BavelasGroup with questions or comments you may have. BavelasGroup welcomes these e-mail communications and makes efforts to respond to these communications where appropriate.

E-mail communications and the ideas sent to BavelasGroup in these e-mail communications become the property of BavelasGroup. BavelasGroup uses the e-mail communications to evaluate and improve its services and Web site. BavelasGroup also may save these e-mail communications for future reference or use.

In an attempt to customize the BavelasGroup service and provide Investors and Advisors and businesses with the information they may be most interested in, BavelasGroup also conducts internal research on our database's demographics, interests, and behavior based upon information provided directly to BavelasGroup and information that BavelasGroup may collect from third party sources. BavelasGroup may combine or otherwise overlay some or all of the foregoing information to build profiles about the BavelasGroup database, which may be individual specific or in aggregate form. By contributing to the BavelasGroup database data contributors consent to BavelasGroup employing the foregoing techniques in its continuing efforts to better serve its customers by providing them with the information in which they may be most interested. BavelasGroup does not use information about its users for any purposes unrelated to the services offered by BavelasGroup.

As discussed above, BavelasGroup may, from time to time, obtain information about Investors and Advisors from third party sources. Please be aware that this Privacy Policy does not cover the conduct or practices of these third party sources. However, BavelasGroup will treat information that it receives from third party sources according to the terms of this Privacy Policy.

Privacy Policy for Investors

What Information is Available?

As part of the BavelasGroup service, Investors are asked to provide an e-mail address, postal address, phone, and a password. In addition, Investors are asked to respond to seven questions that will aid in their search for Financial Advisors. This information is never revealed to any Financial Advisor or any other party unless authorized by the Investor first.

Protection of Investor Information

BavelasGroup undertakes substantial efforts to protect the confidentiality of the identity, preferences and other information it has collected about individual users and will never knowingly allow access to this information to anyone outside BavelasGroup other than for the services BavelasGroup offers.

Investors should also do their part in protecting their information. Unfortunately, neither BavelasGroup nor data transmission over the Internet can be guaranteed to be 100% secure. As a result, while we strive to protect our database information, BavelasGroup cannot ensure or warrant the security of our information. Thus, any information a client transmits to us is done so at the client's own risk. Once we receive investor information, BavelasGroup undertakes substantial efforts to protect the confidentiality of this information consistent with this Policy.

Reviewing or Modifying User Information or Terminating Use

An investor in the BavelasGroup database may choose at any time to review, modify or permanently remove all information stored by BavelasGroup about them. An investor in the BavelasGroup database can also send an e-mail to admin@BavelasGroup.com  to terminate their existence in the BavelasGroup database. If an investor terminates their existence, the terminated records will no longer receive any communications from BavelasGroup, unless received again from another client in the future. BavelasGroup will not sell, rent, or otherwise use the information about terminated records.

Privacy Policy for Financial Advisors

As part of the BavelasGroup service, Advisors are asked to provide an e-mail address, postal address, phone, and a password. In the cases where the Advisor wishes to purchase an expanded listing, we request credit card information via a secure process. In addition, Advisors are asked to respond to a number of questions that will aid investors in their search for Financial Advisors. Each of these data fields will be available for Investors to view.

In addition to the information provided by Financial Advisors, BavelasGroup also collects information about Advisors from multiple third party sources, including the Discovery database suite of Financial Intermediaries, which is a product of the Financial Information Group Inc, one of the sponsors of BavelasGroup. Because basic information about the Financial Advisors is public domain and gathered from public sources, Financial Advisors' basic information cannot be removed from BavelasGroup.

In order to create a more effective tool for Investors to find Financial Advisors, BavelasGroup regularly acquires new data from public and commercial sources and will ask Financial Advisors to contribute new data to BavelasGroup.

Financial Advisors can remove data the Financial Advisor previously contributed to BavelasGroup, but cannot remove data that is public domain or received from commercially available sources.

By accessing or using the service, you (User) agree to be bound by the terms and conditions set forth below. The Sponsors may change this agreement at any time and any changes shall be effective immediately upon posting of the modified agreement. You agree to review this agreement periodically to be aware of such changes and use of the service shall be considered acceptance of the modified agreement.

Except as specifically set forth below, the Product, data, and any documentation are provided "as is" without warranty of any kind, either expressed or implied. The portion of data that has been obtained from public, private, and other sources is believed to be reliable but may not necessarily be complete, nor does The Company guarantee the accuracy or completeness of the data.

The Sponsors MAKES NO WARRANTIES, EXPRESSED OR IMPLIED, INCLUDING SPECIFICALLY, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE AS TO THE PRODUCT OR THE DATA PROVIDED UNDER THIS AGREEMENT. FUTHERMORE, BAVELASGROUP AS A PURE DIRECTORY, DOES NOT ENDORSE OR RECOMMEND ANY PARTICULAR ADVISOR, NOR VALIDATES ANY OF THE CLAIMS OR ASSERTIONS MADE BY THE ADVISORS ADVERTISING IN THIS DIRECTORY. ADVISORS ARE SOLEY REPSONSIBLE FOR THE ADDITIONAL CONTENT THEY POST TO THIS SITE AND BAVELASGROUP IS NOT RESPONSIBLE FOR ANY CONTENT POSTED BY ANY ADVISOR.

Limitations of Use

User agrees that use of the Service is for the purpose of providing individual investors information on Financial Advisors, and for use by the Financial Advisors listed in this site to perform competitive intelligence in the Financial Advisor marketplace. BavelasGroup may not be used for any commercial purpose, including, but not limited to marketing or prospecting to the Advisors, telephone solicitation of any kind, or direct mail. Users are strictly forbidden to copy or replicate any data found in BAVELASGROUP, by means of manual replication, screen capture methods or any form of electronic or automatic software or mechanical device or system. No information in BAVELASGROUP is permitted to be sold or given to any other party. Persons violating this restriction may be subject to legal action by BAVELASGROUP and will be liable for unlimited liquidated damages.

Right to refuse any listing content

BAVELASGROUP reserves the right to reject any Advisor listing, or portion of an Advisors' listing that BAVELASGROUP deems to be inappropriate due to language, content, or statements made by the Advisor. Content posted by Advisors that may be offensive including, but not limited to commentary on race, religion, sexual orientation may be removed by BAVELASGROUP. This will in no way be interpreted to mean that BAVELASGROUP reviews or finds acceptable any or all of the directory listings, rather if offensive material is found BAVELASGROUP reserves the right to remove it.

Indemnification

User agrees to indemnify The Sponsors' and hold it harmless from all claims and damages, including without limitation, reasonable attorneys' fees, arising out of Users' use of the Product or the data, unless such claims or damages result from the gross negligence of The Company in providing the Service or unless Users authorized use of the Product or the data has given rise to the claims or damages based on the infringement of any copyright or other proprietary right of any third party (except if such infringement relates to data supplied by User).

Term; Termination

This Agreement may be terminated by either party without notice at any time for any reason. The provisions of the sections titled "Indemnification" and "Miscellaneous" shall survive any termination of this Agreement.

Member Submitted Content

BavelasGroup�, hereafter referred to as BAVELASGROUP, contains articles, blogs and forum postings written and submitted by financial advisors who are not directly affiliated with BAVELASGROUP, hereafter referred to as third parties.

BAVELASGROUP is not responsible for any errors, omissions, inaccuracies or incompleteness contained in articles submitted by third parties. Additionally BAVELASGROUP does not accept liability for any damages or injuries of any kind that are caused by content submitted by any third party.  The inclusion of an article written by a third party does not represent, in any way, an endorsement of that individual or group by BavelasGroup, and, by accessing any BAVELASGROUP article written by a third party, the user assumes the risk that certain information in those articles may be out of date, inaccurate or contain falsehoods. BAVELASGROUP will make all reasonable efforts to remove any third party articles that have been reported as being inaccurate, out of date or offensive, but offers no guarantees as to the timeliness of their removal.

Miscellaneous

User acknowledges and agrees that all proprietary rights in the Product and the data are and shall remain the sole property of The Sponsors and its third-party licensors. Customer acknowledges that the Product, the data, and all copies thereof were compiled, prepared, selected and arranged by The Sponsors and its licensor through the expenditure of substantial time, effort and money and that they constitute valuable property of The Sponsors and its licensors. The Sponsors retains full rights to the application, licensing, and data, which may not be published or distributed in any form without the express written consent of The Sponsors. User further agrees that use of the Service is for the purpose of introducing individual investors to Financial Advisors, and may not be used for any other commercial purpose. This Agreement shall all be governed and construed in accordance with the laws of the Delaware. The Sponsors may assign its rights and duties under this Agreement to any party at any time without notice to you.
